Das OLG Düsseldorf hat einem einstweiligen Verfügungsverfahren entschieden (Az. 1-20 U 176/11 [55]), dass der Inhaber einer Marke für eine GPL-Software die werktitelmäßige Verwendung des geschützten Namens nicht verbieten darf, etwa wenn die Bezeichnung nicht für einen Hinweis auf eine betriebliche Herkunft verwendet wird, sondern darauf, welches Programm in einem Produkt installiert ist.
